1. Who we are and what these terms cover
IslaEd (“IslaEd,” “we,” “us,” “our”) operates islaed.com and sells digital educational materials, including the Puerto Rico Unit Study, mini units, and free resources.
These Terms and Conditions govern your use of this website and your purchase and use of anything we sell or give away. By browsing the site, downloading a free resource, creating an account, or completing a purchase, you agree to these terms. If you do not agree, do not use the site or our materials.
If you are purchasing on behalf of a school, district, co-op, or other organization, you represent that you have authority to bind that organization to these terms.
Contact: hola@islaed.com
2. What you are buying
Every product we sell is a digital file, delivered as a PDF download. You are not buying a physical product, a printed book, a course, a subscription, or access to a service. Nothing will be shipped to you.
Product descriptions, page counts, and lesson counts are provided in good faith and are accurate at the time of publication. We may revise materials after purchase; see Section 8.
3. License: what you may and may not do
When you purchase a product, you receive a limited, non-exclusive, non-transferable, revocable license to use it as described below. You do not acquire ownership of the material.
You MAY:
- Use the material to teach the children in one household, or the students in one classroom under one teacher.
- Print as many physical copies as those students require, for as many years as you teach them.
- Display the material on a screen, tablet, or projector for those students.
- Store a personal backup copy of the files.
You MAY NOT:
- Share, send, email, upload, or give the files to anyone outside your household or classroom.
- Post the files, or any substantial portion of them, on any website, cloud drive, shared folder, learning management system accessible beyond your own students, social media platform, or file-sharing service.
- Resell, sublicense, rent, lend, or redistribute the material, in whole or in part, whether or not for money.
- Use the material for a co-op, multi-family group, pod, tutoring business, camp, or any setting beyond one household or one classroom, without purchasing an appropriate site license. Contact hola@islaed.com for site licensing.
- Modify, adapt, translate, or create derivative works from the material and distribute them.
- Remove, obscure, or alter any copyright notice, branding, or attribution.
- Use the material, in whole or in part, to train, fine-tune, or otherwise develop any artificial intelligence or machine learning system.
- Use the material or any part of it in any commercial product or service.
A license is granted to the purchasing account. Download links are tied to that account and are not transferable.
Breach
We may revoke your license and terminate your account access, without refund, if you materially breach this section. Revocation does not limit any other remedy available to us.
4. Intellectual property
All content on this site and in our products — including text, lesson scripts, illustrations, maps, diagrams, photographs, worksheets, layouts, the IslaEd name, and the IslaEd logo — is owned by IslaEd or used under license, and is protected by United States copyright and trademark law.
Nothing in these terms transfers any intellectual property right to you.
Factual information about Puerto Rico’s geography, history, and culture is not itself claimed as proprietary. Our particular expression, selection, arrangement, and presentation of that information is.
Reporting infringement
If you believe material on this site infringes your copyright, send a notice meeting the requirements of 17 U.S.C. § 512(c)(3) to hola@islaed.com.
5. Accounts
Some purchases require you to create an account so that your downloads can be tied to you. You are responsible for keeping your login credentials confidential and for all activity under your account.
Tell us promptly at hola@islaed.com if you believe your account has been accessed without your authorization.
We may suspend or terminate an account that we reasonably believe is being used to breach these terms.
6. Prices, payment, and taxes
Prices are shown in U.S. dollars and may change at any time. The price that applies to your order is the price displayed at checkout.
Payment is processed by third-party payment providers. We do not receive or store your full card number. Your use of those services is subject to their own terms.
You are responsible for any sales, use, value-added, or similar tax applicable to your purchase that is not collected at checkout. Where we are required to collect such tax, it will be shown at checkout.
Discount codes
Discount codes are issued at our discretion, are not transferable unless stated, may be limited in quantity and duration, and may be withdrawn at any time. A code has no cash value. We may refuse or reverse a discount obtained through error, abuse, or unauthorized distribution of a code.
7. Delivery, downloads, and refunds
Delivery
Files are delivered by download immediately after payment is confirmed, and a link is sent by email to the address on the order. It is your responsibility to provide a working email address and to check spam and promotions folders.
Download links may be subject to limits on the number of downloads or the period during which they remain active. You may re-access your files by signing in to your account.
If something goes wrong
If a download fails, a file is corrupted, or you do not receive your files, contact hola@islaed.com and we will provide a working copy. This is the remedy we offer for delivery problems.
Refunds
All sales are final. Because these are instant digital downloads that cannot be returned once delivered, we do not offer refunds, exchanges, or cancellations.
Before purchasing, you can review a complete free sample lesson and free printable resources on this site, which show the format, depth, and approach of the material.
Nothing in this section limits any right you may have under applicable consumer protection law that cannot lawfully be excluded.
Chargebacks
If you initiate a chargeback or payment dispute without first contacting us to resolve the issue, we may suspend your account and revoke your license pending resolution. We reserve the right to recover associated costs.
8. Updates and availability of materials
We may revise, update, correct, expand, or withdraw any product at any time. We are not obligated to provide revised versions to prior purchasers, although we may choose to.
We do not guarantee that any product, resource, or page will remain available indefinitely. We strongly recommend you download and keep your own copy of any file you purchase. Continued availability of download links through your account is a convenience, not a guarantee.
9. Educational content: what we do and do not promise
Our materials are supplemental educational resources. They are not a complete curriculum, not accredited, and not a substitute for compliance with any legal requirement that applies to you.
No guarantee of outcomes
We make no representation or warranty that use of our materials will produce any particular educational result, test score, grade, credit, or level of understanding.
Standards alignment
References to NGSS, Common Core State Standards, NCSS/C3, or any other framework are provided as a good-faith mapping for your convenience. They do not constitute endorsement, approval, accreditation, or certification by any standards body, department of education, or accrediting agency, and none of those organizations is affiliated with us.
Your legal obligations
You are solely responsible for determining whether these materials satisfy the homeschool, charter, private school, or public school requirements that apply in your jurisdiction, and for complying with those requirements. Requirements vary by state, territory, and country.
Accuracy
We take care with historical, scientific, and cultural accuracy, and we revise materials when we learn of errors. We do not warrant that every statement is free of error or reflects every scholarly view. History in particular is contested, and reasonable sources disagree.
Sensitive subject matter
Some lessons address colonization, forced labor, enslavement, armed conflict, disease, and population collapse. This material is written plainly and without graphic detail, and lessons containing it carry a note to that effect.
You are responsible for previewing material before teaching it and for deciding what is appropriate for the children in your care, given their age, maturity, and personal circumstances. We are not responsible for a child’s emotional response to historical content.
10. Activities, materials, and supervision
Our materials include hands-on activities. These activities may involve, among other things, scissors and cutting tools, clay and modeling compounds, paints and markers, small parts, and other craft materials.
All activities require appropriate adult supervision. You are solely responsible for:
- Assessing whether an activity is appropriate for the age, ability, and circumstances of each child.
- Supervising children throughout.
- Reviewing the safety information and allergen information for every product and material you obtain to carry out an activity.
- Providing a safe environment.
We do not supply any physical materials and have no control over what you obtain or how it is used.
You assume all risk arising from carrying out any activity described in our materials. To the fullest extent permitted by law, we disclaim all liability for injury, allergic reaction, illness, or property damage arising from any activity.
11. Field trips, travel, and real-world locations
Some of our materials describe, recommend, or provide guidance about real locations, including forests, trails, caves, coastal and marine areas, bioluminescent bays, historic sites, and other outdoor or public places.
Read this section carefully.
- We do not own, operate, control, inspect, or supervise any location described in our materials.
- Information about access, opening hours, fees, conditions, difficulty, reservations, and safety is provided for general interest only, may be inaccurate, and may be out of date at the time you read it. Conditions change. Sites close. Always verify directly with the operator or managing agency before you travel.
- Outdoor activity carries inherent risks, including but not limited to uneven and slippery terrain, falling, flooding, rapid weather change, heat, dehydration, drowning, strong currents, wildlife, insects, plants, limited mobile signal, and remoteness from medical assistance. Cave and night-time water activities carry additional risks.
- You are solely responsible for deciding whether to visit any location, for assessing conditions at the time, for your own safety and the safety of anyone in your care, for obtaining any required permit or reservation, for carrying appropriate equipment, and for obtaining appropriate insurance.
- Nothing in our materials is a recommendation that any particular person visit any particular place, or a representation that any place is safe or suitable.
To the fullest extent permitted by law, we assume no liability whatsoever for any injury, death, illness, loss, or damage arising from or connected to any visit to any location mentioned in our materials.
12. Third-party content and links
Our site and materials may link to or reference third-party websites, videos, books, organizations, products, and services, including our own YouTube channel and social media accounts.
We do not control third-party content and are not responsible for it, for its accuracy, for its continued availability, or for any harm arising from it. A link or reference is not an endorsement.
Any dealings you have with a third party are solely between you and that third party.
13. Community spaces
If we operate a community group on a third-party platform, participation is voluntary and is subject to that platform’s own terms as well as these terms and any group rules we publish.
You are responsible for anything you post. Do not post material you do not have the right to share, including our files or files from other publishers. We may remove content and remove participants at our discretion.
Information shared by other participants is their own, not ours. We do not verify it and are not responsible for it.
14. Email and communications
By providing your email address, you agree that we may contact you about your order, your account, and the materials you have obtained.
If you opt in to our list, we may also send you occasional updates and offers. You may unsubscribe from marketing emails at any time using the link in any such email. You cannot unsubscribe from transactional emails about an order while an order is active.
15. Acceptable use
You agree not to:
- Use the site for any unlawful purpose.
- Attempt to gain unauthorized access to any part of the site, any account, or any system or network connected to it.
- Interfere with, disrupt, or place undue load on the site.
- Use any automated system to scrape, harvest, index, or copy content from the site, except for ordinary search engine indexing.
- Circumvent any access control, download limit, or licensing mechanism.
- Impersonate any person or misrepresent your affiliation with any person or organization.
16. Privacy
Our collection and use of personal information is described in our Privacy Policy, which forms part of these terms.
17. Disclaimer of warranties
To the fullest extent permitted by law, the site and all materials are provided “as is” and “as available,” without warranty of any kind, express or implied.
We specifically disclaim all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the site will be uninterrupted, timely, secure, or error-free, that defects will be corrected, or that the site or the servers that make it available are free of viruses or other harmful components.
Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, our liability is limited to the minimum extent permitted by law.
18. Limitation of liability
To the fullest extent permitted by law:
We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or opportunity, arising out of or connected to these terms, the site, or any material, whether based in contract, tort, negligence, strict liability, or otherwise, and whether or not we have been advised of the possibility of such damages.
Our total aggregate liability arising out of or connected to these terms, the site, or any material, for all claims combined, will not exceed the greater of (a) the amount you actually paid us in the twelve months preceding the event giving rise to the claim, or (b) fifty U.S. dollars ($50).
These limitations apply even if a remedy fails of its essential purpose.
Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, our liability is limited to the minimum extent permitted by law.
19. Indemnification
You agree to indemnify, defend, and hold harmless IslaEd and its owner, employees, and contractors from and against any claim, demand, loss, liability, damage, cost, or expense (including reasonable attorneys’ fees) arising out of or connected to:
- Your breach of these terms;
- Your use of the site or any material;
- Any activity you conduct or location you visit based on our materials;
- Your violation of any law or of any right of a third party;
- Any content you post in a community space.
20. Force majeure
We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including hurricane, earthquake, flood, fire, power or telecommunications failure, internet or hosting provider outage, labor dispute, act of government, or civil unrest.
21. Changes to these terms
We may revise these terms at any time. The revised version takes effect when posted to this page, and the “Last updated” date will change. Your continued use of the site after that date constitutes acceptance.
The terms in effect at the time of your purchase govern that purchase, except where a later change is required by law.
22. Governing law and disputes
These terms are governed by the laws of the Commonwealth of Puerto Rico, without regard to its conflict of laws rules.
You agree that any dispute arising out of or connected to these terms or the site will be brought exclusively in the courts located in Puerto Rico, and you consent to the personal jurisdiction of those courts.
Nothing in this section deprives you of the protection of any mandatory consumer protection provision of the law of the place where you reside.
23. General
Severability. If any provision of these terms is held unenforceable, that provision will be modified to the minimum extent necessary, or severed, and the remaining provisions will remain in full force.
No waiver. Our failure to enforce any provision is not a waiver of it.
Assignment. You may not assign these terms. We may assign them in connection with a sale or transfer of the business.
Entire agreement. These terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the site and our materials, and supersede any prior understanding.
Headings. Section headings are for convenience only.
